PPCMOI – Regularization of exterior renovation work – 46, rue Charlevoix – Hull-Wright electoral district – Steve Moran

CONSIDERING THAT a request aimed at the regularization of exterior renovation work has been formulated for the property located at 46, rue Charlevoix;

CONSIDERING THAT exterior renovation work was carried out in 2023 and 2024 without obtaining a building permit beforehand;

CONSIDERING THAT the work carried out aimed at the modification of the exterior cladding, the enlargement of a gallery, the construction of an eave, and the modification of certain openings;

CONSIDERING THAT the work carried out on the gallery and the eave caused situations of regulatory non-compliance and new situations of encroachment outside the limits of the property targeted by this request;

CONSIDERING THAT the regularization of the renovation work already carried out requires the approval of a special project for the construction, modification, or occupancy of a building (PPCMOI) under the Règlement relatif aux projets particuliers de construction, de modification ou d'occupation d'un immeuble numéro 507-2005 since this work was not subject to the issuance of a building permit;

CONSIDERING THAT corrective work will be required in order to eliminate the encroachment of the front gallery and the eave outside the property limits;

CONSIDERING THAT a stop-work order and a notice of violation were issued by the Service de l’urbanisme et du développement durable in the context of processing this request;

CONSIDERING THAT the project is also subject to approval under the Règlement relatif aux plans d’implantation et d’intégration architecturale numéro 505-2005;

CONSEQUENTLY, this Committee recommends that the council approve, under the Règlement relatif aux projets particuliers de construction, de modification ou d'occupation d'un immeuble numéro 507-2005, a project at 46, rue Charlevoix, in order to authorize the proposed corrective work which requires a regularization of the following elements:

  • Increase the maximum encroachment of a gallery in a margin adjacent to a street from 2 m to 2.63 m;
  • Reduce the minimum distance between a gallery and a property line from 1 m to 0 m;
  • Reduce the minimum distance between an exterior staircase and a property line from 1 m to 0.16 m;
  • Reduce the minimum distance between an eave and a property line from 1 m to 0 m.
