Zoning Bylaw – Modify Co-04-054 commercial zone boundaries, add residential use class, and create a new commercial zone – Lac-Beauchamp Electoral District – Denis Girouard
Questions, answers, and comments were formulated regarding, among other things:
- A property in the new commercial zone is of the CGI use class;
- The water capacity on the street to accommodate this project remains to be evaluated. There is no mechanism allowing the administration to not recommend a zoning change due to insufficient water capacity on the street; only the objectives of the Schéma d'aménagement and the urban plan are the parameters of acceptability during the analysis;
- The project will contribute to improving the living environment of this residential sector;
- The obligation to offer commercial premises on the ground floor of buildings in this sector of Maloney Boulevard could hinder rehabilitation efforts in the sector. The building's commercial premises have been vacant for over a year;
- A request was made to inquire about the typology of the project's housing units.

CONSIDERING THAT a request for a zoning amendment aimed at authorizing the transformation of a commercial building into housing has been formulated for the property located at 561, boulevard Maloney Est;
CONSIDERING THAT the property and the Co-04-054 zone targeted by the request fall under a residential designation in the Schéma d'aménagement et de développement numéro 2050-2016 and the Plan d'urbanisme numéro 530-2020;
CONSIDERING THAT residential buildings are already present in the targeted zone, either in mixed-use buildings with residential and commercial uses or in buildings composed strictly of housing units;
CONSIDERING THAT the commercial premises of the building targeted by the intervention have been vacant for some time and that the applicant has demonstrated that a transformation into multi-family housing comprising four units is technically possible;
CONSIDERING THAT the project submitted by the applicant has not been analyzed in its entirety, and that it may require minor variances to Règlement de zonage numéro 532-2020, if the zoning amendment comes into force;
CONSIDERING THAT following a contextual analysis, it is appropriate to modify the boundaries of the Co-04-054 commercial zone, add the Habitation (H) use class to it, and create a new commercial zone, all in order to respond to the request submitted by the applicant;
CONSIDERING THAT the request complies with the orientations and objectives of the Plan d'urbanisme numéro 530-2020 and the Schéma d'aménagement et de développement numéro 2050-2016;
CONSIDERING THAT a vote is requested, and that six members vote for the project, one member votes against, and one member is absent;
CONSEQUENTLY, this Committee recommends that the council approve an amendment to Règlement de zonage numéro 532-2020 in order to modify the boundaries of the Co-04-054 commercial zone, add the Habitation (H) use class to it, and create a new commercial zone within the Co-04-054 zone, all as presented in this project analysis.
