Questions, answers, and comments were formulated regarding, among other things:

  • The project is located in a residential zone, but in the heart of a commercial sector;
  • The business is the only restaurant offering video lottery terminals in the Masson-Angers district;
  • If the use is authorized by the council, a modification to the business permit will be required;
  • Interior renovation work on the building has not begun;
  • The Urban Planning and Sustainable Development Department justifies its unfavorable recommendation by the project's location in a residential environment and because the requested use is not authorized in the zone.

CONSIDERING THAT a request aimed at authorizing dependent and additional commercial uses leading to the use of video lottery terminals has been formulated for the property located at 845, chemin de Masson;

CONSIDERING THAT the authorization of non-compliant commercial uses in the commercial zone Co-02-088 requires the adoption of a projet particulier de construction, de modification ou d’occupation d’un immeuble (PPCMOI), since the specification grid of the targeted zone does not specifically permit these commercial uses, some of which are acquired rights that one wishes to modify;

CONSIDERING THAT the use of video lottery terminals is normally permitted in more "recreational" commercial zones where distinctive businesses and services (bars) are better "controlled" and authorized as of right;

CONSEQUENTLY, this Committee recommends that the council approve, pursuant to the Règlement relatif aux projets particuliers de construction, de modification ou d'occupation d'un immeuble numéro 507-2005, a project aimed at authorizing dependent and additional commercial uses exceeding the areas and ratios prescribed by the Règlement de zonage numéro 532-2020 or acquired rights, as well as the use of eight video lottery terminals, at 845, chemin de Masson, according to the following parameters:

  • Permit an additional use of "Lottery and gambling" (video lottery terminals) as a dependent use of "Establishment where drinks are served and various activities" (c5b) in a restaurant;
  • Increase from 15% to 15.5% the ratio between the floor area of a dependent use "Establishment where drinks are served" and the total floor area of the main use;
  • Increase from 48 m2 to 51.8 m2 the floor area of a dependent use "Establishment where drinks are served";
  • Increase from 5% to 19.3% the ratio between the area of the additional use "Lottery and gambling" and the floor area of the dependent use "Establishment where drinks are served" (increase in the number of video lottery terminals).

Questions, answers, and comments were formulated regarding, among other things:

  • It would have been desirable to suggest to the applicant the possibility of re-vegetating the non-compliant portion of the parking space that encroaches on the width of the facade. It is recalled that the City has invested significantly in an ecological transition strategy. Greater collaboration between municipal departments is desired.

CONSIDERING THAT a request aimed at regularizing the construction of a semi-detached single-family home, built without obtaining a building permit beforehand, has been formulated for the property located at 278, rue Alexandre-Rodrigue;

CONSIDERING THAT the building does not respect the provisions concerning the minimum rear setback and the maximum encroachment of a driveway and parking space on the main facade;

CONSIDERING THAT the building/land ratio as well as the area of amenity spaces remain compliant with the Règlement de zonage numéro 532-2020, despite the building's encroachment into the rear setback;

CONSIDERING THAT the area of asphalt paving, generated by the excess encroachment of the parking space on the main facade of the building, has little impact on the increase of heat islands (the width of the driveway remains compliant);

CONSIDERING THAT the project respects the majority of applicable criteria of the Règlement relatif aux projets particuliers de construction, de modification ou d'occupation d'un immeuble numéro 507-2005;

CONSEQUENTLY, this Committee recommends that the council approve, pursuant to the Règlement relatif aux projets particuliers de construction, de modification ou d'occupation d'un immeuble numéro 507-2005, a project at 278, rue Alexandre-Rodrigue, in order to regularize the construction of a semi-detached single-family home, as illustrated in the project analysis in the documents:

  • Site plan identifying the non-conformities subject to the PPCMOI – Simon Dufour Handfield, land surveyor – June 17, 2024 – 278, rue Alexandre-Rodrigue;
  • Comparison between the original building plan and that of the built building – SUDD – November 5, 2024 – Dessins Drummond – March 5, 2020 – 278, rue Alexandre-Rodrigue;
  • Comparison between the elevations of the original building plan and those of the built building – SUDD – November 5, 2024 – Dessins Drummond – March 5, 2020 – 278, rue Alexandre-Rodrigue.

And this, conditionally:

  1. To the submission, at the building permit application stage, of plans and elevations of the building as built, compliant with the Règlement de zonage numéro 532-2020 and the Règlement de construction numéro 504-2005;
  2. To the planting of a tree in the backyard of the building;
  3. To the issuance of a building permit to regularize the construction of the building.
