CONSIDERING THAT the City of Gatineau owns lot 5 428 972 of the Quebec cadastre, land registration division of Hull, which is the site of the Robert-Guertin arena located at 125, rue de Carillon;

CONSIDERING THAT, given the urgency of the homelessness situation in the territory of the City of Gatineau, the non-profit organization Transition Québec wishes to erect a transitional and temporary housing village, composed of transformed new shipping containers, which will be able to accommodate up to 100 people experiencing homelessness;

CONSIDERING THAT the City, by its resolution number CM-2024-758 of October 10, 2024, supported this project by agreeing to grant an emphyteutic lease to the organization Transition Québec for a portion of the Robert-Guertin arena site for the construction of the transitional housing village;

CONSIDERING THAT since the adoption of the aforementioned resolution, the City has established an assistance program through the adoption of a bylaw aimed at promoting the construction and development of social-purpose rental housing, which allows, among other things, the donation of an emphyteutic lease for the realization of a rental housing project intended for people experiencing homelessness;

CONSIDERING THAT modifications have been made to the promise of an emphyteutic lease and that the signing of a new agreement is required:

PROPOSED AND UNANIMOUSLY RESOLVED that this committee recommends to the council:

• to grant an emphyteutic lease to Transition Québec for a portion of lot 5 428 972 of the Quebec cadastre, land registration division of Hull, with an area of approximately 8,763.5 m2, for which a new lot will be registered in the Quebec cadastre shortly;

• to authorize the mayor or, in her absence, the acting mayor, and the clerk or, in her absence, the deputy clerk or assistant clerk, to sign an emphyteutic lease substantially in accordance with the promise of an emphyteutic lease attached to this resolution, the main elements of which are as follows:

o Transition Québec will have the obligation to build a real estate and movable property complex intended to be used for offering social services to people experiencing homelessness and making rental housing available to them for the purpose of transitional and temporary accommodation;

o At the end of the emphyteutic lease, Transition Québec must return the land to the City with the following improvements: ▪ The connection for the electrical power supply shipping container; ▪ The fences delimiting the property complex; ▪ The landscaping of the land;

o The emphyteutic lease will be conditional upon the issuance of a certificate of eligibility for the assistance program aimed at promoting the construction and development of social-purpose rental housing;

o The emphyteutic lease will be granted free of charge and for a period of 10 years from the signing of the notarial deed;

o The City commits to working in collaboration with Transition Québec to assist it in finding solutions following the end of the current lease, notably through the relocation of the containers or through a new emphyteutic lease.

• to mandate the City Clerk's Office to prepare the necessary documents related to the transaction and coordinate all steps required to follow up on this;

• to authorize the Real Estate Department to carry out the proper management of the transaction, ensuring compliance with the terms and conditions of the deed to be executed;

• to repeal resolution number CM-2024-758;

• to remove the public character of a portion of lot 5 428 972 of the Quebec cadastre, land registration division of Hull, with an area of approximately 8,763.5 m2, for which a new lot will be registered in the Quebec cadastre shortly.

The mayor or, in her absence, the acting mayor, and the clerk or, in her absence, the deputy clerk or assistant clerk are authorized to sign the documents for the purposes of this resolution.

A treasurer's certificate was issued on December 12, 2024.

This recommendation of the executive committee comes into effect on the day of its approval by resolution of the municipal council.

CONSIDERING THAT the City has adopted a Cadre de référence municipal en itinérance (CM-2020-598) and wishes to contribute, through concrete actions, to the implementation of the established orientations and objectives;

CONSIDERING THAT orientation 1 of this reference framework aims for everyone to have a suitable roof, thereby addressing issues surrounding access to and maintenance of housing;

CONSIDERING THAT the housing crisis in the region exacerbates the situation of homelessness;

CONSIDERING THAT the legislator has intervened on several occasions, for more than a year, to modify the laws applicable to municipalities in order to provide for a general competence in housing matters and to add several powers that can be exercised for the purposes of this competence;

CONSIDERING, in particular, section 84.4 of the Loi sur les compétences municipales (RLRQ, c. C-47.1);

CONSIDERING THAT in this context, the City wishes to contribute financially to the construction or development of rental housing intended for people experiencing homelessness, under the conditions provided for in this Règlement 968-2024:

PROPOSED AND UNANIMOUSLY RESOLVED that this committee recommends to the council to promote the construction and development of social-purpose rental housing resulting from Règlement 968-2024:

• Authorize the treasurer to pay a financial contribution of $1,500,000 from the homelessness assistance reserve;

• Grant an emphyteutic lease for lot 5 428 972 over a period of 10 years free of charge, but for the purposes of the program, it is valued at $4,000,000;

• Provide municipal services, including access to premises or loan of equipment, but excluding services identified in Règlement 98-2003 concerning agreements relating to municipal works, valued at $25,000.

The mayor or, in her absence, the acting mayor, and the clerk or, in her absence, the deputy clerk or assistant clerk are authorized to sign any document necessary to give full effect to this resolution.

A treasurer's certificate was issued on December 12, 2024.
