Zoning Bylaw – Modify boundaries of zones Ha-02-004 and Pu-02-098 – 150, rue de la Papetière – Masson-Angers District – Michael Korhonen
Questions, answers, and comments were formulated, concerning among other things:
- The developer is attempting to maximize their project due to regulatory changes beyond their control. It is no longer possible to build in low-flow zones, and it is not possible to grant variances regarding regulatory provisions related to environmental protection;
- The portion of land that was ceded for park purposes will be subdivided into four lots. The compensation for park purposes will ultimately be monetary;
- Connections to municipal services will be at the developer's expense;
- It is noted that residents purchased their property in this project believing there would be a park. It is replied that there is already an existing park, and that the initial objective was to expand it. The area of the existing park remains sufficient for the sector.

CONSIDERING THAT a request for a zoning change aimed at finalizing phase 1 of the Jardins du Littoral project was formulated for zones Pu-02-098 and Ha-02-004, in the Masson-Angers sector;
CONSIDERING THAT this change would allow for the construction of four semi-detached homes on rue de la Papetière after a cadastral operation, replacing the six semi-detached homes planned on rue des Becs-Scie;
CONSIDERING THAT zone Ha-02-004 consists of phases already completed for the Jardins du Littoral project and includes buildings of similar dimensions to what is projected in the phase to be developed;
CONSIDERING THAT on July 12, 2019, by decree 817-2019, the government implemented the Special Intervention Zone (ZIS) and that it has no impact on the project, since it is entirely outside the ZIS;
CONSIDERING THAT in August 2021, by resolution CM-2021-569, the street opening PIIA (Site Planning and Architectural Integration Program) was approved, including the buildings located at 377, 381, 385, 389, 393, and 397, rue des Becs-Scie, all located in part in the low-flow zone (20 – 100 years);
CONSIDERING THAT in March 2022, the transitional regime was adopted and it is no longer possible to build in the low-flow zone (20 - 100 years), even with the implementation of immunization measures;
CONSIDERING THAT the requested modification to the current zoning bylaw by the applicant is consistent with the orientations and objectives of the Plan d’urbanisme number 530-2020 and the residential designation of the sector provided for in these planning tools;
CONSIDERING THAT the Service de l’urbanisme et du développement durable (SUDD) deems it appropriate to propose a regulatory modification that is consistent with the orientations and objectives of the Plan d’urbanisme number 530-2020;
CONSEQUENTLY, this Committee recommends that Council approve a modification to Zoning Bylaw number 532-2020, aiming to:
- Expand zone Ha-02-004 into a portion of zone Pu-02-098.
