2025.09.09 – Regular meeting of the Gatineau City Executive Committee held in the committee room of the Maison du citoyen, 25 Laurier Street, Gatineau, on Tuesday, September 9, 2025 at 2:00 p.m.

CONSIDERING THAT this committee, by its resolution number CE-2020-660 of October 28, 2020, awarded to the firm A4 & Juxta in consortium a contract for the provision of professional architectural services for the restoration of the building located at 205, rue Montcalm, for a total amount of $183,218.41 including taxes;

CONSIDERING THAT this committee, by its resolution number CE-2022-560 of June 29, 2022, awarded to the firm 6739741 Canada inc. (Gestion DMJ) a contract for the execution of restoration work on the building located at 205, rue Montcalm, for a total amount of $4,570,831.13 including taxes;

CONSIDERING THAT due to the discovery of soil contamination more significant than expected in the basement of 205, rue Montcalm, this level of contamination has a significant impact on the initial scope of the building restoration project;

CONSIDERING THAT article 2125 of the Civil Code of Quebec allows the City, as a client, to unilaterally terminate a contract, even if the execution of the work or the provision of the service has already begun;

CONSIDERING THAT article 2129 of the Civil Code of Quebec requires that the City, as a client, be held to pay the firm the value of the services rendered before the end of the contract or before the notification of the termination:

PROPOSED AND UNANIMOUSLY RESOLVED THAT this committee:

• terminate the contract with the firm A4 & Juxta in consortium for professional architectural services related to the restoration of the building located at 205, rue Montcalm; • authorize the payment to the firm A4 & Juxta in consortium of the amount of professional fees for services rendered and not invoiced, in accordance with article 2129 of the Civil Code of Quebec; • terminate the contract with the firm 6739741 Canada inc. (Gestion DMJ) for the execution of restoration work on the building located at 205, rue Montcalm; • authorize the payment to the firm 6739741 Canada inc. (Gestion DMJ) of the amount incurred for work and expenses for services rendered and not invoiced, in accordance with article 2129 of the Civil Code of Quebec.

CONSIDERING THAT this committee, by its resolution number CE-2022-86 of February 9, 2022, awarded to the firm Confluence Architecture a contract for the provision of professional architectural services related to the restoration of the building located at 2, rue de Lorimier, for a total amount of $246,621.38 including taxes;

CONSIDERING THAT the presence of asbestos found throughout the building significantly modifies the scope of the initial project;

CONSIDERING THAT article 2125 of the Civil Code of Quebec allows the City, as a client, to unilaterally terminate a contract, even if the execution of the work or the provision of the service has already begun;

CONSIDERING THAT article 2129 of the Civil Code of Quebec requires that the City, as a client, be held to pay the firm the value of the services rendered before the end of the contract or before the notification of the termination:

PROPOSED AND UNANIMOUSLY RESOLVED THAT this committee terminate the contract with the firm Confluence Architecture for professional architectural services related to the restoration of the building located at 2, rue de Lorimier.

CONSIDERING THAT the Tour de Gatineau will take place from September 19 to 21, 2025;

CONSIDERING THAT street closures and traffic control are essential elements for the safety of participants;

CONSIDERING THAT the Police Service ensures traffic control for the entire duration of the event;

CONSIDERING THAT the costs related to road traffic modifications (signage plan and police surveillance) are provided for in the municipal budget, according to the terms in effect in the Event Support Program, via resolution number CM-2025-337;

CONSIDERING THAT the installation of the required temporary road signage is the responsibility of the organization according to the standards in effect:

PROPOSED AND UNANIMOUSLY RESOLVED THAT this committee authorize the closure of roads and parking lots (including parking meters) according to the following schedule:

The following conditions must be met:

• Submit, for approval by the Ville de Gatineau, a temporary signage plan respecting the standards of Quebec road signage and municipal requirements; • Ensure an emergency lane at all times during the event; • Release the Ville de Gatineau from any liability for damage to others that may result from the holding of the event and provide to the Events Office of the Service des arts, de la culture et des lettres, no later than two weeks before the event, insurance forms designating the Ville de Gatineau as an additional insured, liability and indemnification, as well as general civil liability for an amount of $3,000,000.
