CONSIDERING THAT the City of Gatineau is the owner of lot 5 428 972 of the Quebec cadastre, land registration division of Hull, being the site of the Robert-Guertin arena located at 125, rue de Carillon;
CONSIDERING THAT given the urgency of the homelessness situation in the territory of the City of Gatineau, the non-profit organization Transition Québec wishes to erect a transitional and temporary housing village, composed of new converted shipping containers, which will be able to accommodate up to 100 people experiencing homelessness;
CONSIDERING THAT the City wishes to support this project and, consequently, support the fight against homelessness by granting an emphyteutic lease to the organization Transition Québec for a portion of the Robert-Guertin arena site for the construction of the transitional housing village;
CONSIDERING THAT the registration of new lots is required in order to register the emphyteutic lease at the Land Registry Office, the City and Transition Québec undertake to sign an emphyteutic lease, as soon as the new lot is registered in the Quebec cadastre;
CONSIDERING THAT all concerned municipal services have been consulted and are in favor of this transaction:
PROPOSED AND UNANIMOUSLY RESOLVED THAT this committee recommends to the council:
• to grant an emphyteutic lease to Transition Québec for a portion of lot 5 428 972 of the Quebec cadastre, land registration division of Hull, with an area of approximately 8,762.22 m2, for which a new lot will be registered in the Quebec cadastre shortly; 0021072
• to authorize the mayor or in her absence the acting mayor and the clerk or in her absence the deputy clerk or the assistant clerk to sign all documents relating to an emphyteutic lease substantially in accordance with the promise of emphyteutic lease attached to this resolution and whose main elements are as follows:
Transition Québec will have the obligation to improve the leased land by erecting a real estate complex intended to be used for the temporary housing of people experiencing homelessness. The improvements include in particular the construction of a water system, the installation and connection of habitable shipping containers, as well as the landscaping of the land;
The emphyteutic lease will be granted free of charge;
The emphyteutic lease will be granted for a period of 10 years from the signing of the notarial deed.
• to mandate the Clerk's Office to prepare the necessary documents relating to the transaction and coordinate all the steps required to follow up on this;
• to authorize the Real Estate Department to carry out the proper management of the transaction by ensuring compliance with the terms and conditions of the deed to be entered into;
• to repeal resolutions numbers CM-2024-476 and CM-2024-569;
• to remove the public character of a portion of lot 5 428 972 of the Quebec cadastre, land registration division of Hull, with an area of approximately 8,762.22 m2, for which a new lot will be registered in the Quebec cadastre shortly.

CONSIDERING THAT Transition Québec wishes to collaborate with the City and has a mission that is directly linked to the objectives of the City;
CONSIDERING THAT the City has adopted a Municipal Framework on Homelessness (Cadre de référence municipal en itinérance - CM-2020-598) and that it wishes to ensure the development of partnerships and internal and external consultations aimed at the coherence of actions and their complementarity;
CONSIDERING THAT orientation 1 of the Municipal Framework on Homelessness aims to have suitable housing for all and to find answers to the issues surrounding access to and retention of housing;
CONSIDERING THAT the housing crisis in the region exacerbates the situation of homelessness;
CONSIDERING THAT the City recognizes Transition Québec as a privileged partner in order to reduce the pressure on the continuum of services, by offering a solution to support the most vulnerable citizens; 0021074
CONSIDERING THAT the City is willing to support Transition Québec for the implementation of the Village Transition project which aims to create a living space adapted to the needs of people experiencing homelessness;
CONSIDERING THAT the municipal council, by its resolution number CM-2023-563, of July 4, 2023, authorized the allocation from surplus funds, of a sum of $5,000,000 to the "Homelessness Assistance" reserve, in order to invest in various actions on homelessness;
CONSIDERING THAT Transition Québec is subject to the specific financial reporting requirements of the Auditor General, in accordance with sections 107.9 and 107.7 of the Loi sur les cités et villes:
PROPOSED AND UNANIMOUSLY RESOLVED THAT this committee recommends to the council:
• to approve the partnership memorandum of understanding between the City of Gatineau and Transition Québec substantially in accordance with the draft attached in the appendix;
• to authorize the mayor or in her absence the acting mayor and the clerk or in her absence the deputy clerk or the assistant clerk to sign the memorandum of understanding for the years 2024-2025 with Transition Québec, attached hereto as well as any other document to give full effect to it;
• to authorize the treasurer to draw the sum of $1.5 M from the $5 M homelessness assistance reserve in order to finance the memorandum of understanding;
• to authorize the treasurer to issue checks to Transition Québec, responsible for the memorandum of understanding mentioned above as well as according to the terms and conditions stipulated in the memorandum of understanding to be entered into with Transition Québec, upon presentation of supporting documents prepared by the Recreation, Sports and Community Development Department.
This recommendation of the executive committee comes into force on the day of its approval by resolution of the municipal council. Adopted

CONSIDERING THAT the organization Transition Québec has filed a request to proceed, at its own expense and in accordance with the regulations in force, with the installation of municipal services to serve the Village Transition project;
CONSIDERING THAT an agreement must be signed between the City of Gatineau and the organization Transition Québec in order to establish the guidelines governing the construction of municipal services in the Village Transition project:
PROPOSED AND UNANIMOUSLY RESOLVED THAT this committee recommends to the council:
• to accept the agreement to be entered into between the City of Gatineau and the organization Transition Québec concerning the Village Transition project, shown on the overall plans prepared by the firm CIMA+, s.e.n.c., bearing the number G-2024-037-02 1/2;
• to ratify the request presented by the aforementioned organization to build, at its own expense and in accordance with the regulations in force of the City of Gatineau (Règlements numéros 98-2003 et 99-2003 and their amendments), the municipal services required to serve the project; 0021073
• to notify the ministère de l’Environnement, de la Lutte contre les changements climatiques, de la Faune et des Parcs that the City of Gatineau does not object to the issuance of the authorization required for the installation of municipal services in this project;
• to notify the ministère de l’Environnement, de la Lutte contre les changements climatiques, de la Faune et des Parcs that the City of Gatineau undertakes to maintain the stormwater management works that will be transferred to it, if applicable, and to register them in its operation and maintenance register;
• to certify that the existing water and sewer networks are capable of serving the project mentioned above and comply with the various infrastructure master plans;
• to authorize the aforementioned organization to have prepared, also at its own expense, the specifications and plans necessary for the execution of the work referred to above by the firm CIMA+, s.e.n.c.;
• to endorse the request of the aforementioned organization aimed at entrusting the supervision, with residence, of the aforementioned work to the firm CIMA+, s.e.n.c. and that the expense resulting therefrom be assumed by this organization;
• to require that the company, its successors and legal heirs transfer to the City of Gatineau, free of charge, the municipal services and the easements required in this project;
• to authorize the mayor or in her absence the acting mayor and the clerk or in her absence the deputy clerk or the assistant clerk to sign the agreement, the contract relating to the obtaining of the easements which are the subject of this, all as they will appear on the final plans which will be filed at the Land Registry Office.
