CONSIDERING THAT a request to allow the expansion of a main building was submitted for the property located at 111, rue Gerard-Gauthier;

CONSIDERING THAT the building currently houses the Centre d’hébergement et de soins de longue durée (CHSLD) de la Vallée-de-la-Lièvre, and that the proposed expansion is part of the maisons des aînés (MDA) model being implemented by the ministère de la Santé et des Services sociaux;

CONSIDERING THAT the project requires the granting, by the council, of two minor variances to Zoning Bylaw number 532-2020 regarding the side setback on rue Bergeron and the rear setback;

CONSIDERING THAT these variances do not compromise the “enjoyment of property rights” of the owners of neighboring buildings;

CONSIDERING THAT the proposed expansion complies with all regulatory provisions, except for those for which minor variances to the current Zoning Bylaw are requested;

CONSEQUENTLY, this Committee recommends that the council grant two minor variances to Zoning Bylaw number 532-2020, aimed at the expansion of the building located at 111, Gerard-Gauthier, in order to reduce:

• The minimum rear setback from 10 m to 8 m;

• The minimum side setback on the street from 10 m to 9.5 m (rue Bergeron).

CONSIDERING THAT a request to regularize renovation and volumetric modification work for a detached single-family home was submitted for 41, rue Millar;

CONSIDERING THAT the modifications to the rear volume of the main building were carried out by the applicant without obtaining a building permit, as required by Article 45 of the Règlement d’administration des règlements d’urbanisme numéro 501-2005, and that they do not comply with current regulations;

CONSIDERING THAT any modification to the building's placement must be carried out in accordance with current regulations, which require, according to the zoning specification grid (Ha-08-166), a minimum distance of 7 m between the building wall and the rear line, whereas the building is located, after the volumetric modifications, at 4 m from said line;

CONSIDERING THAT a special project for construction, modification, or occupancy of an immovable (PPCMOI) must be approved under the Règlement relatif aux projets particuliers de construction, de modification ou d’occupation d’un immeuble numéro 507-2005 to regularize the situation;

CONSIDERING THAT the project must also be approved under the Règlement relatif aux plans d’implantation et d’intégration architecturale numéro 505-2005, since the property is located in the downtown preservation sector and specifically in landscape unit 4.3 Quartier Millar – Hardley;

CONSEQUENTLY, this Committee recommends that the council approve, under the Règlement relatif aux projets particuliers de construction, de modification ou d'occupation d'un immeuble numéro 507-2005, a project at 41, rue Millar, in order to regularize the volumetric modification and renovation of the main building having the following characteristic:

• A building wall located 4 m from the rear line.

All as illustrated in the project analysis in the document:

• Site plan – Beaulieu construction produced on the basis of the extract of the certificate of location plan produced by Roger Bussières, land surveyor, dated November 25, 2009 – 41, rue Millar – November 3, 2023, and annotated by the SUDD;

• Elevations produced – Beaulieu construction – 41, rue Millar – November 3, 2023, and annotated by the SUDD.

And this, conditionally upon:

• The planting of a tree in the front yard of the property;

• The completion of the work to replace the windows identified on the rear facade with new windows with wired glass in a steel frame to comply with the current Building Code;

• The approval of the project by the council under the Règlement relatif aux plans d’implantation et d’intégration architecturale numéro 505-2005.
