2025.09.17 – Regular meeting of the Executive Committee of the City of Gatineau held by videoconference, – Gatineau, Wednesday, September 17, 2025, at 9:33 a.m., at which are present, Ms.

CONSIDERING THAT during a first call for tenders process (2024 SP 138), the firm Équipe Laurence inc., the sole bidder, submitted a bid declared non-compliant, having attached the price offer to the service offer;

CONSIDERING THAT a new process (2024 SP 138A) was launched and by its resolution number CE-2025-597, the Executive Committee awarded a contract to the firm CIMA+, s.e.n.c. in the amount of $761,203.49, taxes included;

CONSIDERING THAT during this process, the bid from Équipe Laurence inc. had been declared non-compliant. However, the bid analyzed during the evaluation was not the one submitted by the firm Équipe Laurence inc., but rather the bid obtained during the first process (2024 SP 138);

CONSIDERING THAT following the awarding of the mandate and the receipt of the response letter sent to the firm Équipe Laurence inc., the latter contacted the responsible Procurement Department informing us that it had indeed submitted the service offer and the price offer separately as required according to article 2.3, "Conformité de la soumission" (Bid Compliance) of the Administrative Clauses booklet;

CONSIDERING THAT the responsible Procurement Department analyzed the situation and communicated with all stakeholders to ensure the compliance of the process for the sake of fairness, integrity, and transparency;

CONSIDERING THAT the selection committee proceeded with the evaluation of the documents submitted by the firm Équipe Laurence inc. according to the established process;

CONSIDERING THAT after evaluation by the selection committee following the authorized grid, the bid from the firm Équipe Laurence inc. is the one that obtained the best score, in accordance with the authorized evaluation grid:

PROPOSED AND UNANIMOUSLY RESOLVED THAT this committee:

• Rescinds the contract awarded by resolution number CE-2025-597 to the firm CIMA+, s.e.n.c., 420, boulevard Maloney Est, unit 201, Gatineau, Quebec, J8P 1E7, for a total amount of $761,203.49 including taxes;

• Awards a contract to the firm Équipe Laurence inc., 135, boulevard de Sainte-Adèle, Sainte-Adèle, Quebec, J8B 0J4, for professional consulting engineering services - Slope stabilization - Georges and Côte-des-Neiges streets, for a total amount of $400,572.90 including taxes, in compliance with the tender documents and its bid submitted on April 26, 2025, as being the bid that obtained the best score following evaluation by a selection committee, all in accordance with the authorized evaluation grid;

• Authorizes the firm Équipe Laurence inc. to submit any authorization request as well as all required documents relating to this work to the competent authorities in the matter, if the situation makes it necessary, and to present any commitment in connection with the authorization requests required for the "Stabilisation de talus – Rues Georges et de la Côte-des-Neiges" projects;

• Confirms the City's commitment to submit to the ministère de l’Environnement, de la Lutte contre les changements climatiques, de la Faune et des Parcs and the concerned authorities, no later than 60 days after the end of the work or according to the prescribed deadlines, an attestation signed by an engineer or an authorized professional, as the case may be, regarding the compliance of the work with the granted authorizations.

A treasurer's certificate was issued on September 15, 2025.

PROPOSED AND UNANIMOUSLY RESOLVED THAT this committee:

• Awards a contract to the firm CIMA+, s.e.n.c., 700, boulevard du Carrefour, office 201, Gatineau, Quebec, H3A 2R7, for consulting services, concept development, coordination services, preparatory studies, preparation of plans, specifications and tender documents, as well as services during construction for the Wabassee Creek daylighting project – Zone A, located in the Gatineau sector, for a total approximate amount of $4,742,718.75 including taxes, all in compliance with the tender documents and its bid submitted on July 24, 2025, as being the bid that obtained the best final score after evaluation by a selection committee, all in accordance with the authorized evaluation grid;

• Authorizes the firm CIMA+, s.e.n.c. to submit any authorization request as well as all required documents relating to this work to the ministère de l’Environnement, de la Lutte contre les changements climatiques, de la Faune et des Parcs (MELCCFP), to Fisheries and Oceans Canada (DFO) and Transport Canada, and to present any commitment in connection with the authorization requests required for the Wabassee Creek daylighting project – Zone A;

• Authorizes the firm CIMA+, s.e.n.c. to submit any authorization request as well as all required documents relating to this work to the competent authorities in the matter, if the situation makes it necessary, and to present any commitment in connection with the authorization requests required, for the Wabassee Creek daylighting project – Zone A;

• Confirms the City's commitment to submit to the ministère de l’Environnement, de la Lutte contre les changements climatiques, de la Faune et des Parcs and the concerned authorities, no later than 60 days after the end of the work or according to the prescribed deadlines, an attestation signed by an engineer or an authorized professional, as the case may be, regarding the compliance of the work with the granted authorizations.

CONSIDERING THAT on March 28, 2024, the City transmitted the assessment notice for the property located at 2, chemin de Montréal Ouest;

CONSIDERING THAT the owner contested the assessment of the property located at 2, chemin de Montréal Ouest and on October 23, 2024, filed an appeal with the Tribunal administratif du Québec;

CONSIDERING THAT the hearing was held in Gatineau on February 3, 4, 5, 6, 2025, and in Montreal on February 12 and April 29, 2025;

CONSIDERING the decision of administrative judges Philippe Tremblay and Jacqueline Francoeur rendered on July 25, 2025, partially granting the applicants' appeals;

CONSIDERING THAT Commandite Papier Masson WB Ltée filed, on August 21, 2025, an application for leave to appeal the decision rendered by the Tribunal administratif du Québec;

CONSIDERING THAT it is in the interest of the City to file a cross-appeal on a specific question concerning the presence of economic obsolescence:

PROPOSED AND UNANIMOUSLY RESOLVED THAT this committee mandates the firm DHC Avocats inc. to undertake all required steps to file a cross-appeal in the files bearing numbers SAI-Q-258657-2110 and SAI-Q-258661-2110.
