CONSIDERING THAT the firm Stantec Experts-conseils ltée. has filed an additional request for professional fees with the City in the amount of $42,419.92 including taxes, for additional site and office supervision as well as an adjustment of supervision fees, bringing the cumulative total of adjustments to be approved to $70,589.13 including taxes;
CONSIDERING THAT under Règlement 816-2017 concerning the delegation of power from the executive committee to certain officials, including the power to authorize expenditures and enter into contracts on behalf of the City of Gatineau, a resolution of the executive committee is required since the adjustment amount exceeds the limit provided for in the bylaw;
CONSIDERING THAT after verification, the Infrastructure and Projects Department recommends this cost adjustment for the additional professional fees incurred:

• ratifies delegation of power number 191342, for an amount of $28,169.21 including taxes; • authorizes the cost adjustment for additional professional fees incurred in the amount of $42,419.92 including taxes, to the firm Stantec Experts-conseils ltée., without budgetary impact, as part of the municipal service repair project on Rue Charles-Desnoyers and in the Rue Ducerre sector, thus bringing the cumulative total of adjustments to be approved to an amount of $70,589.13 including taxes.

CONSIDERING THAT Rue Coulombe, Rue Cadieux, and Rue Duquette Ouest were built and developed several years ago;
CONSIDERING THAT according to the property index of the Land Registry Office of the circonscription foncière de Hull, it appears that the transfer of titles for these streets has not been carried out and that the lots still belong to a company;
CONSIDERING THAT section 72 of the Loi sur les compétences municipales allows a local municipality to become the owner of any road open to public traffic for at least 10 years, when the formalities prescribed by law have been completed, which are:
- The municipality adopts a resolution identifying the road concerned, either by its cadastral designation when its footprint corresponds to that of one or more whole lots of the current cadastre, or, otherwise, by a technical description prepared by a land surveyor;
- Where applicable, a copy of the technical description, certified by a land surveyor, is filed at the Municipality's Office;
- The municipality publishes twice, in a newspaper distributed on its territory, a notice containing:
- the full text of this article;
- a summary description of the road concerned;
- a declaration stating that the formalities provided for in paragraphs 1 and 2 have been completed;
- No property tax has been levied by the municipality over the last 10 years;
CONSIDERING THAT despite the procedures prescribed by section 72 of the Loi sur les compétences municipales, the City adopted Règlement 851-2023 on the procedures for publishing notices under section 345.1 of the Loi sur les cités et villes (RLRQ c C-19), taking precedence over the procedures prescribed by that same Act or by any other laws, allowing the publication of the two notices on the City of Gatineau's website;
CONSIDERING THAT the City of Gatineau deems it in the public interest to avail itself of this procedure to obtain a valid property title for these streets:
PROPOSED AND RESOLVED UNANIMOUSLY THAT this committee decrees that the City of Gatineau intends to avail itself of the procedure enacted in section 72 of the Loi sur les compétences municipales regarding the obtaining of the property title for lots 1 770 132, 1 770 138, and 1 770 447 of the cadastre du Québec, circonscription foncière de Hull, as being Rue Coulombe, Rue Cadieux, and part of Rue Duquette Ouest and, to this effect, recognizes the cadastral designation identifying the roads concerned.
It is further resolved that this committee mandates the City Clerk's Office to follow up on this and authorizes the City Clerk or, in her absence, the Deputy City Clerk or the Assistant City Clerk to sign the declarations of ownership to be published at the Land Registry Office.
