2024.11.27 – Regular meeting of the Executive Committee of the City of Gatineau held in the committee room of the Maison du citoyen, 25 Laurier Street, Gatineau, on Wednesday, November 27, 2024 at 9:30 a.m.

CONSIDERING THAT this committee, by its resolution number CE-2019-129 of March 13, 2019, awarded a mandate to the consulting engineering firm Stantec Experts-conseils ltée. for the design, preparation of plans and specifications, and site supervision for municipal service repair work on Rue Charles-Desnoyers and in the Rue Ducerre sector, for an approximate total amount of $236,768.76 including taxes;

CONSIDERING THAT this committee, by its resolution number CE-2022-316 of April 27, 2022, authorized a cost adjustment for professional consulting engineering fees in the amount of $55,045.93 including taxes, to the firm Stantec Experts-conseils ltée., for additional design and site supervision as part of the municipal service repair work on Rue Charles-Desnoyers and in the Rue Ducerre sector, bringing the total cumulative amount of the mandate to $291,814.69 including taxes;

CONSIDERING THAT delegation of power number 191342 has already been approved for an amount of $28,169.21 including taxes;

CONSIDERING THAT the firm Stantec Experts-conseils ltée. has filed an additional request for professional fees with the City in the amount of $42,419.92 including taxes, for additional site and office supervision as well as an adjustment of supervision fees, bringing the cumulative total of adjustments to be approved to $70,589.13 including taxes;

CONSIDERING THAT under Règlement 816-2017 concerning the delegation of power from the executive committee to certain officials, including the power to authorize expenditures and enter into contracts on behalf of the City of Gatineau, a resolution of the executive committee is required since the adjustment amount exceeds the limit provided for in the bylaw;

CONSIDERING THAT after verification, the Infrastructure and Projects Department recommends this cost adjustment for the additional professional fees incurred:

PROPOSED AND RESOLVED UNANIMOUSLY THAT this committee:

• ratifies delegation of power number 191342, for an amount of $28,169.21 including taxes; • authorizes the cost adjustment for additional professional fees incurred in the amount of $42,419.92 including taxes, to the firm Stantec Experts-conseils ltée., without budgetary impact, as part of the municipal service repair project on Rue Charles-Desnoyers and in the Rue Ducerre sector, thus bringing the cumulative total of adjustments to be approved to an amount of $70,589.13 including taxes.

The total revised cost of the mandate, following this adjustment, represents an amount of $362,403.82 including taxes. A treasurer's certificate was issued on November 22, 2024.

CONSIDERING THAT the organization L'Amicale des personnes handicapées physiques de l'Outaouais obtained, on February 17, 2015, recognition for property tax exemption purposes for the building located at 405 Rue Notre-Dame, with the exception of the apartment on the 2nd floor of the building;

CONSIDERING THAT the Loi sur la fiscalité municipale provides for the periodic review of the recognition every nine years;

CONSIDERING THAT the organization L'Amicale des personnes handicapées physiques de l'Outaouais has requested the renewal of the property tax exemption for the building located at 405 Rue Notre-Dame;

CONSIDERING THAT the Commission municipale du Québec may confirm the recognition of the property tax exemption after consultation with the City:

PROPOSED AND RESOLVED UNANIMOUSLY THAT this committee agrees to defer to the decision of the Commission municipale du Québec to confirm the recognition of the property tax exemption granted to the organization L'Amicale des personnes handicapées physiques de l'Outaouais for the building located at 405 Rue Notre-Dame;

Furthermore, this committee wishes to inform the Commission municipale du Québec that should a hearing be held to allow for a decision in this file, the City will not be present.

CONSIDERING THAT Rue Coulombe, Rue Cadieux, and Rue Duquette Ouest were built and developed several years ago;

CONSIDERING THAT according to the property index of the Land Registry Office of the circonscription foncière de Hull, it appears that the transfer of titles for these streets has not been carried out and that the lots still belong to a company;

CONSIDERING THAT section 72 of the Loi sur les compétences municipales allows a local municipality to become the owner of any road open to public traffic for at least 10 years, when the formalities prescribed by law have been completed, which are:

1. The municipality adopts a resolution identifying the road concerned, either by its cadastral designation when its footprint corresponds to that of one or more whole lots of the current cadastre, or, otherwise, by a technical description prepared by a land surveyor;
2. Where applicable, a copy of the technical description, certified by a land surveyor, is filed at the Municipality's Office;
3. The municipality publishes twice, in a newspaper distributed on its territory, a notice containing:
   • the full text of this article;
   • a summary description of the road concerned;
   • a declaration stating that the formalities provided for in paragraphs 1 and 2 have been completed;
4. No property tax has been levied by the municipality over the last 10 years;

CONSIDERING THAT despite the procedures prescribed by section 72 of the Loi sur les compétences municipales, the City adopted Règlement 851-2023 on the procedures for publishing notices under section 345.1 of the Loi sur les cités et villes (RLRQ c C-19), taking precedence over the procedures prescribed by that same Act or by any other laws, allowing the publication of the two notices on the City of Gatineau's website;

CONSIDERING THAT the City of Gatineau deems it in the public interest to avail itself of this procedure to obtain a valid property title for these streets:

PROPOSED AND RESOLVED UNANIMOUSLY THAT this committee decrees that the City of Gatineau intends to avail itself of the procedure enacted in section 72 of the Loi sur les compétences municipales regarding the obtaining of the property title for lots 1 770 132, 1 770 138, and 1 770 447 of the cadastre du Québec, circonscription foncière de Hull, as being Rue Coulombe, Rue Cadieux, and part of Rue Duquette Ouest and, to this effect, recognizes the cadastral designation identifying the roads concerned.

It is further resolved that this committee mandates the City Clerk's Office to follow up on this and authorizes the City Clerk or, in her absence, the Deputy City Clerk or the Assistant City Clerk to sign the declarations of ownership to be published at the Land Registry Office.

CONSIDERING THAT the City of Gatineau has carried out development work for a multi-use path on the south side of Avenue Lépine, between Avenue de Buckingham and Chemin Findlay;

CONSIDERING THAT Avenue Lépine, between Avenue de Buckingham and Chemin Findlay, crosses a railway track at mile point 2.36 of the Buckingham branch, belonging to the company Chemins de fer Québec-Gatineau inc. and that the level crossing requires widening work on the crossing surface to accommodate the development of the new multi-use path:

PROPOSED AND RESOLVED UNANIMOUSLY THAT this committee:

• authorizes the signing of agreement no. 129_002-36 XRAG regarding the widening of the crossing surface, at mile point 2.36 of the Buckingham branch, belonging to the company Chemins de fer Québec-Gatineau inc.; • authorizes the expenditure of $21,500.33 including taxes, to the company Chemins de fer Québec-Gatineau inc., to cover the cost of the widening work for the Avenue Lépine level crossing to accommodate the development of a multi-use path on the south side of the road.

The funds for this purpose will be taken from sub-project 21517.01 - SIS RAU-FDI-19-3070 Piste avenue Lépine – Construction and improvement of the cycling network – règlement 852-2020.

A treasurer's certificate was issued on November 22, 2024.

CONSIDERING THAT under resolution number CE-2022-560 of June 29, 2022, the City of Gatineau awarded a contract to the firm 6739741 Canada inc. (Gestion DMJ), for the restoration work of the building at 205 Rue Montcalm, for a total amount of $4,570,831.13 including taxes;

CONSIDERING THAT additional costs covered by change orders for an amount of $203,219.55 including taxes, were authorized under delegations of power numbers 190335, 191156, and 192922 and modification notices numbers 10084 and 10262;

CONSIDERING THAT the professionals on the file recommend a total amount of $170,137.80 including taxes, for the completion of all additional costs that have been necessary to date;

CONSIDERING THAT under Règlement 816-2017 concerning the delegation of power from the executive committee to certain officials, including the power to authorize expenditures and enter into contracts on behalf of the City of Gatineau, a resolution of the executive committee is required since the cumulative amount of additional fees exceeds the 10% limit provided for in the bylaw or is greater than $250,000 including taxes;

CONSIDERING THAT after analysis, the Infrastructure and Projects Department recommends the approval of these additional costs:

PROPOSED AND RESOLVED UNANIMOUSLY THAT this committee:

• ratifies the delegations of power numbers 190335, 191156, and 192922 and the modification notices numbers 10084 and 10262 for a total amount of $203,219.55 including taxes; • authorizes the additional amount of $170,137.80 including taxes, to the contract of Gestion DMJ, thus bringing the bid cost adjustment to the amount of $373,357.35 including taxes, without budgetary impact.

The total cost of this adjusted contract represents an amount of $4,944,188.48 including taxes. The funds for this purpose will be taken from sub-projects 20505.01 and 21237.01.
