2024.06.26 – Ordinary meeting of the Gatineau City executive committee held in the committee room of the Maison du citoyen, 25 Laurier Street, Gatineau, on Wednesday, June 26, 2024, at 9:30 a.m.

CONSIDERING THAT organizations wishing to modify certain established elements of their 2024 support requests must submit a request;

CONSIDERING THAT the services have analyzed the modification requests received and that others are to come over the next few months;

CONSIDERING THAT the Arts, Culture and Letters Department recommends that Council approve the proposed modification requests for 2024 projects supported by:

• The Support Programs for Major Events and Events under $50,000 (CM-2023-745 and CM-2024-49);
• The Cultural Animation Support Fund (CM-2024-52);
• The Support Program for Cultural Organizations (CM-2024-62):

PROPOSED AND UNANIMOUSLY RESOLVED THAT this committee recommend that Council accept the changes presented in Appendix A. A treasurer's certificate was issued on June 21, 2024. This recommendation of the Executive Committee comes into effect on the day of its approval by resolution of the City Council.

CONSIDERING THAT in 2023, the City of Gatineau submitted a project as part of the Call for Projects for the support of commemoration initiatives launched by the ministère de la Culture et des Communications du Québec, that it obtained funding to commemorate Les allumettières – 100 ans après (initially titled L’été des allumettières) and that it wishes, for this purpose, to install a commemorative marker highlighting the 100th anniversary of the 2nd labor conflict opposing the matchmakers to E.B. Eddy;

CONSIDERING THAT a working committee evaluated different sites for the integration of the commemorative marker and, based on symbolic, functional, and technical criteria, Place des Contremaîtresses (located at 25, rue Jos-Montferrand, Gatineau, QC, J8X 0E2) was selected as the preferred integration site;

CONSIDERING THAT Windmill Dream Québec Holdings LP, owner of Place des Contremaîtresses, expressed support for the implementation of a commemorative marker in memory of the matchmakers at this location;

CONSIDERING THAT the team at Windmill Dream Québec Holdings LP has previously consulted and approved the plans, concepts, technical drawings, and texts of the commemorative marker:

PROPOSED AND UNANIMOUSLY RESOLVED THAT this committee accept:

• To ratify the agreement and its appendices between the City of Gatineau and Windmill Dream Québec Holdings LP for the integration of the commemorative marker at Place des Contremaîtresses, located at 25, rue Jos-Montferrand, for a duration of 20 years or until the City of Gatineau becomes the owner of the site;
• To authorize the Mayor or in her absence the Acting Mayor and the City Clerk or in her absence the Deputy City Clerk or the Assistant City Clerk to sign the agreement attached hereto as well as any other document to give it full effect and any amendment to the agreement.

CONSIDERING THAT the 32nd edition of the Gatineau Triathlon, organized by the Club Espoir Triathlon Gatineau, will take place on Saturday, July 6, 2024;

CONSIDERING THAT the street closure and traffic control by the Gatineau Police Service are essential elements for the holding of the event and the safety of the participants;

CONSIDERING THAT the costs related to police services are covered by the Support Program for Major Events via resolution number CM-2024-49, adopted on January 23, 2024;

CONSIDERING THAT the application of the required temporary signage plan and the costs associated with it are chargeable to the organization:

PROPOSED AND UNANIMOUSLY RESOLVED THAT this committee authorize the event organizers, in collaboration with the Gatineau Police Service, to close the streets to traffic according to the following schedule:

Emergency vehicles will have access to all the streets mentioned above if the situation requires it. Residents who are owners or tenants on the streets mentioned above will have access to their property or business at all times via alternative streets.

All under the following conditions:

1. Respect the temporary signage plan G-16-040-01 prepared by the Mobility Department and entrust its application to an authorized company;
2. Ensure access for emergency vehicles at all times during the event;
3. Obtain a general civil liability insurance certificate of at least $3,000,000 designating the City of Gatineau as an additional insured.

PROPOSED AND UNANIMOUSLY RESOLVED THAT this committee award a contract to the following firms, all in compliance with the tender documents and the bids submitted on April 15, 2024, the firms having submitted the lowest bids received and compliant for each section, namely:

• The firm Agence Gravel inc., 5175, rue John-Molson, Québec, Québec, G1X 3X4, for section 1 concerning the purchase of practice ammunition for a period of two years for an approximate amount of $174,721.76 including taxes;
• The firm Korth Group LTD., 64186-393 Loop East, Okotoks, Alberta, T1S 0L1, for section 2 concerning the purchase of service ammunition for a period of two years for an approximate amount of $19,184.72 including taxes.

After the first year of the contract, the unit prices will be revised annually, all based on the Consumer Price Index of Statistics Canada. The contracts may be renewed for an additional period of one year, which would bring the contract for section 1 to $262,082.64 taxes included, and for section 2 to $28,777.09 taxes included.

The funds for this purpose will be taken from the following budget item:

Furthermore, the treasurer is authorized to provide the necessary sums in the budget for the years 2025 to 2026 to follow up on this. A treasurer's certificate was issued on June 25, 2024.

CONSIDERING THAT the City of Gatineau began a project in 2021 for the reconstruction of Rue Notre-Dame between Boulevard Maloney and Boulevard Labrosse (phase 6);

CONSIDERING THAT the City of Gatineau had to regularize the street right-of-way and certain existing or future infrastructures in view of the development work on this portion of Rue Notre-Dame;

CONSIDERING THAT the company 159315 Canada inc. is the owner of the building located at 267, Rue Notre-Dame in Gatineau, known and designated as lot 3 365 474;

CONSIDERING THAT on or about December 3, 2021, the City of Gatineau and the owner concluded a collaboration agreement concerning the work to be executed on a portion of this building as well as the free transfer in favor of the City of Gatineau of a parcel of this building, which has an area of approximately 80 m2;

CONSIDERING THAT the City of Gatineau and the owner concluded a promise of sale, which was duly signed on September 2 and 7, 2022, and which provides that the owner promises to sell to the City of Gatineau a part of lot 3 365 474 of the cadastre du Québec, in the land registration division of Hull, having an exact area of 79.9 m2;

CONSIDERING THAT the City of Gatineau executed the foundation reconstruction and paving work on an area of approximately 220 m2 of the building and that the City fully assumed the costs, all as compensation for the transfer of a part of the building in accordance with the agreement and the promise of sale;

CONSIDERING THAT the owner committed to signing the deed of sale before a notary within a period of 120 days from the date of establishment of a new cadastre;

CONSIDERING THAT it is necessary that the owner sign the necessary documents with the land surveyor in order to obtain a new cadastre;

CONSIDERING THAT the Legal Affairs Department sent a formal notice to the owner to sign the documents required for obtaining a new cadastre;

CONSIDERING THAT as of today, the documents necessary for obtaining a new cadastre are not signed by the owner despite the sending of said formal notice;

CONSIDERING THAT in the event of the owner's failure to respect the signing deadline provided for in the promise of sale, the City of Gatineau may claim from the latter all losses, costs, damages, and penalties;

CONSIDERING THAT it is necessary that procedures be taken in order to order the owner to sign the documents necessary for obtaining a new cadastre in accordance with the promise of sale concluded and to claim damages, if applicable, within this procedure.

PROPOSED AND UNANIMOUSLY RESOLVED THAT this committee mandate the Legal Affairs Department to introduce any useful procedure with the goal of ordering the owner to sign the documents necessary for obtaining a new cadastre in accordance with the promise of sale concluded and to claim damages, if applicable, within this procedure. A treasurer's certificate was issued on June 21, 2024.
