CONSIDERING THAT the municipal council, by its resolution number CM-2022-33 of January 18, 2022, authorized the private sale of a portion of the road right-of-way of Boulevard Maloney Est to the company Qualizra immobilier, with an approximate area of 220 m2, at a price of $32,000 plus applicable taxes. This land is now designated as lot 6 482 113 of the Quebec Cadastre, Hull land registration division;

CONSIDERING THAT the municipal council also, by its resolution number CM-2022-786 of November 15, 2022, authorized the private sale of a portion of the road right-of-way of Boulevard Maloney Est to the company 11351109 Canada inc., with an approximate area of 1,797.6 m2, at a price of $185,000 plus applicable taxes. This land is now designated as lot 6 482 114 of the Quebec Cadastre, Hull land registration division;

CONSIDERING THAT during the drafting of the notarial deeds, a divergence of opinion between the acting notaries and the legal services of the ministère des Transports et de la Mobilité durable du Québec (Quebec Ministry of Transport and Sustainable Mobility) regarding the actual owner of the aforementioned lands forced the City of Gatineau to mandate the firm RGPL avocats to obtain a legal opinion regarding the legitimacy of its property titles;

CONSIDERING THAT the legal opinion of March 14, 2023, concludes that:

  • The City's property titles relating to these two lots are not sufficiently clear to allow a transaction, thus making it impossible for the City to sell these lands privately;
  • The lands are the property of the ministère des Transports et de la Mobilité durable du Québec, despite the transfer of the road right-of-way of Boulevard Maloney Est to the City of Gatineau under section 6 of the Loi sur la Voirie (Roads Act);

CONSIDERING THAT the City cannot legally proceed with the sales authorized under resolutions CM-2022-33 and CM-2022-786:

PROPOSED AND UNANIMOUSLY RESOLVED THAT this committee recommends to the council:

  • To repeal resolutions CM-2022-33 and CM-2022-786;
  • To mandate the Service du greffe (City Clerk's Office) to coordinate all steps required to follow up on this decision;
