Amendment No. 5 to the Financial Assistance Agreement for Flood Zone Mapping Updates

CONSIDERING the Civil Security Action Plan regarding floods - Towards a more disaster-resilient Quebec society, made public by the Government of Quebec on March 1, 2018;

CONSIDERING THAT under this plan, a financial assistance agreement of $2,800,000 was signed on March 28, 2018 (CM-2018-180), between the ministère des Affaires municipales et de l’Habitation, the City of Gatineau, and the MRCs of Pontiac, des Collines-de-l’Outaouais, and Papineau, aimed at developing flood zone mapping for the Ottawa, Gatineau, Blanche, and Lièvre rivers;

CONSIDERING THAT a first amendment to the agreement was signed on March 29, 2019 (CM-2019-163) to add 112 km of river sections to the agreement territory and provide additional financial assistance of $500,000;

CONSIDERING THAT a second amendment for updating flood zones was signed on March 29, 2021 (CM-2021-131) to extend the agreement to March 31, 2022, and provide additional financial assistance of $90,000;

CONSIDERING THAT a third amendment for updating flood zones was signed on March 31, 2022 (CM-2022-182) to extend the agreement to March 31, 2023;

CONSIDERING THAT a fourth amendment for updating flood zones was signed on March 31, 2023 (CM-2023-204) to extend the agreement to March 31, 2025, add the East Blanche River to the agreed territory, and grant an additional amount of $306,400;

CONSIDERING THAT in 2024, the ministère de l’Environnement, de la Lutte contre les changements climatiques, de la Faune et des Parcs (MELCCFP) will publish new methodological guidelines for the work under the flood zone mapping agreement;

CONSIDERING THAT the requirements established by these new guidelines will necessitate the revision of the hydraulic modeling and mapping already produced and sent to the ministère des Affaires municipales et de l’Habitation on December 23, 2021;

CONSIDERING THAT the City of Gatineau has initiated discussions with the MELCCFP with a view to being delegated the responsibility of establishing the limits of flood zones for lakes and watercourses in the agreed territory and preparing the regulatory mapping:

PROPOSED AND RESOLVED UNANIMOUSLY THAT this committee recommends that council authorize the mayor or, in their absence, the acting mayor, and the clerk or, in their absence, the deputy clerk or assistant clerk, to sign Amendment No. 5 to the financial assistance agreement, providing for additional maximum financial assistance of $390,000 to be paid to the City of Gatineau, as well as the extension of the agreement until March 31, 2026, for updating flood zone mapping according to the new methodological guidelines and preparing the regulatory mapping. CONSIDERING THAT the municipal council, by its resolution number CM-2021-571 of August 24, 2021, and amended by resolution number CM-2023-504 of July 4, 2023, granted a financial contribution of $622,613 for project ACL 7051 – Les Apprentis, equivalent to the 15% community contribution required by the AccèsLogis Québec program;

CONSIDERING THAT at the final commitment stage, geotechnical studies did not reveal the low soil bearing capacity that could require consolidation work;

CONSIDERING THAT it was during excavation work, under the supervision of a specialized consulting firm, that the insufficient soil bearing capacity was identified;

CONSIDERING THAT the contractor, Beaudoin Canada, is claiming $562,607.50 from the organization for the fully executed soil bearing capacity improvement work;

CONSIDERING THAT the AccèsLogis Québec program does not allow for the reimbursement of costs related to unforeseen work under the 'New Construction - Turnkey' project formula;

CONSIDERING THAT to avoid legal proceedings, the organization decided to initiate a mediation process to resolve the dispute with the contractor;

CONSIDERING THAT following the mediation held on April 30, 2024, both parties agreed on an amount of $300,000 plus taxes ($344,925) that the organization must pay to Beaudoin Canada to resolve the dispute;

CONSIDERING THAT the project could be subject to litigation if no credible and definitive solution is reached between the two parties for possession in June 2024;

CONSIDERING THAT Article 91.1 allows any local municipality to grant aid to any solidarity cooperative that has, by its statutes, prohibited itself from distributing a patronage dividend or paying interest on any class of preferred shares;

CONSIDERING THAT the City of Gatineau could finance this request from the allocated surplus – Supplementary Aid for Affordable Housing:

PROPOSED AND RESOLVED UNANIMOUSLY THAT this committee recommends that council:

• grant financial aid of a maximum amount of $344,925, drawn from the allocated surplus – Supplementary Aid for Affordable Housing, to the Coopérative de Solidarité Innovation Habitation Outaouais to cover the costs of the agreement related to soil bearing capacity improvement work, under the following conditions:

CONSIDERING THAT the Bureau des événements recommends that council adopt financial contributions of an amount of $289,275 in cash, an amount of $120,850 in cost-based services, and $42,800 in service value to organizations, in accordance with the budgets allocated to the two support programs concerned:

  • pay an additional maximum sum of $5,000 per organization to those committing to a strategic plan process or a traffic and origin study according to budgetary availability.

In case of exceptional circumstances determined by the City, the contribution in services could be higher than the forecasts, while respecting the limits established in the support programs. The Bureau des événements may, in these circumstances, reimburse invoices to the targeted organizations, upon presentation of supporting documents, or pay suppliers, if applicable.

• authorize the Police Service – Parking Section, adult school crossing guard, and animal control to:

  • provide free or billable parking spaces in certain municipal parking lots;

  • move permit holders to time-limited parking lots or to parking meters (paid spaces);

  • take all arrangements required for the smooth running of the activities concerned;

• authorize the management of the Service des arts, de la culture et des lettres or its representatives to sign the memoranda of understanding as well as any other modification or amendment to the memoranda of understanding with organizations receiving less than $250,000 in subsidies.
