CONSIDERING THAT the 2024-2034 Cultural Policy has a commitment to support the development of structuring real estate projects for Gatineau cultural organizations;

CONSIDERING THAT the City manifests a strong desire to rely on culture and a creative economy to animate the heart of the downtown area and develop a strong cultural hub there;

CONSIDERING THAT the lack of artist studios in Gatineau constitutes a major obstacle to the fulfillment of cultural stakeholders and that it weakens the visual arts ecosystem, harming the retention of our artists and the influence of their talents;

CONSIDERING THAT Les Ateliers du Ruisseau form a solidarity cooperative that wishes to offer workspaces and exhibition spaces to visual arts, fine crafts, and digital arts artists of Gatineau and the Outaouais;

CONSIDERING THAT the municipal council has supported the organization three times with resolutions numbers CM-2020-442 (July 7, 2020), CM-2022-724 (October 18, 2022), and CM-2023-537 (July 4, 2023);

CONSIDERING THAT the organization has been installed, since 2022, at 135, rue Eddy as a tenant and that it has set up nine artist studios there to meet the urgent need for creative space;

CONSIDERING THAT the organization has mobilized to find a permanent solution where it can welcome its members and that it wishes to acquire and adapt the heritage building located at 75, promenade du Portage, to set up 24 artist studios there;

CONSIDERING THAT the cost of the project is estimated at $3,089,318 and that the financing structure relies on a one-time financial participation from the City of Gatineau of $2,300,000, composed of the City's share of $1,959,324 and a subsidized share of $340,676 coming from the ministère de la Culture et des Communications within the framework of the 2025-2027 Cultural Development Agreement and on a mortgage loan contracted by the organization of $789,318 over 20 years;

CONSIDERING THAT this project allows for a significant advance for the improvement of practice conditions, favoring the retention and return of our artists and cultural workers to Gatineau, thus participating in countering their exodus to large centers:

PROPOSED AND UNANIMOUSLY RESOLVED THAT this committee recommends that the council:

• to agree to participate in the financing of the Les Ateliers du Ruisseau project at 75, promenade du Portage by granting the organization a sum of $1,959,324 drawn from the contingency fund to allow for its acquisition and adaptation into 24 artist studios by the organization; • to agree to participate in the financing of the Les Ateliers du Ruisseau project at 75, promenade du Portage by paying the organization a sum of $340,676 from the 2025-2027 cultural development agreement to allow for its acquisition and adaptation into 24 artist studios; • to approve the memorandum of understanding between the City of Gatineau and Les Ateliers du Ruisseau, solidarity cooperative, regarding the acquisition and adaptation into 24 artist studios of the building located at 75, promenade du Portage; • to authorize the mayor or in her absence the acting mayor and the clerk or in her absence the deputy clerk or the assistant clerk to sign the memorandum of understanding between the City of Gatineau and Les Ateliers du Ruisseau, solidarity cooperative, as well as any modification or amendment to said protocol; • to approve the 2nd rank mortgage between the City of Gatineau and Les Ateliers du Ruisseau, solidarity cooperative, regarding the acquisition of the building located at 75, promenade du Portage; • to authorize the mayor or in her absence the acting mayor and the clerk or in her absence the deputy clerk or the assistant clerk to sign the 2nd rank mortgage between the City of Gatineau and Les Ateliers du Ruisseau, solidarity cooperative, as well as any modification or amendment to the mortgage; • to authorize the treasurer to issue payments totaling $2.3M (city share and subsidized share) to Les Ateliers du Ruisseau, solidarity cooperative, according to the clauses and conditions stipulated in the memorandum of understanding upon presentation of supporting documents prepared by the Service des arts, de la culture et des lettres; • to plan to increase the Financial Assistance Program for artist studios by $70,000 and bring it to a maximum of $120,000 annually to reflect the creation of new studios starting in 2028; • to authorize the treasurer to make the required accounting entries to give effect to the present.

CONSIDERING THAT the discussions with the owners have allowed for the conclusion of a mutual agreement, in the amount of $3,100,000 plus taxes if applicable, and this, under the conditions provided for in the standard contract of the City of Gatineau as well as other conditions stipulated in the promise of sale duly signed on September 23, 2025:

PROPOSED AND UNANIMOUSLY RESOLVED THAT this committee recommends that the council:

• to accept the promise of sale and to acquire by mutual agreement lot 1 620 624 of the Quebec Cadastre, Hull land registration division having an area of 1,305.3 m2 and a part of lot 1 620 622 of the Quebec Cadastre, Hull land registration division having an area of 203.8 m2, which are shown in minute 2803, prepared by Doris Lapointe, land surveyor, on August 19, 2025, at the price of $3,100,000 plus taxes, if applicable, under the usual conditions provided for in the standard contract of the City of Gatineau and other conditions stipulated in the promise of sale including notably:

CONSIDERING THAT for several years, drainage issues have been present along chemin de Chambord as well as more generally in the white zone sector during heavy rains, thus causing inconveniences for the residents of the sector;

CONSIDERING THAT in a perspective of sustainable improvement of runoff management (stormwater) and reduction of nuisances for the residents of the sector, the Real Estate Assets Service was mandated by the Asset Planning and Investment Service to proceed with the acquisition of a part of lot 4 064 290 of the Quebec Cadastre, Hull land registration division, with an approximate area of 23,003 m², with a view to building a retention basin there;

CONSIDERING THAT in order to correct in a sustainable manner the recurring drainage problems present in this sector, the City must also become the acquirer of real and perpetual drainage and passage easements on a part of lots 4 064 290, 4 313 992, and 4 064 288 of the Quebec Cadastre, Hull land registration division;

CONSIDERING THAT in parallel, in order to meet the growth needs of the Centre de services scolaire des Draveurs (CSSD), a new school has been planned in the same sector. This need was confirmed by the CSSD in a letter addressed to the mayor of Gatineau, dated September 12, 2025, highlighting the importance of having an adequate site for the realization of this project;

CONSIDERING THAT in accordance with article 272.10 of the Loi sur l’Instruction publique, it is specified that when the sector identified in the planning of space needs of the school service center is included in the territory of a single local municipality, it must cede, free of charge, to the school service center, a building located in this sector in accordance with the characteristics set out in the planning;

CONSIDERING THAT in a desire for coordination, the City wishes to respond in a concerted manner to the needs of citizens by integrating the issues related to stormwater management and those related to school infrastructure, in order to favor a coherent and integrated approach to urban development;

CONSIDERING THAT in this regard, during discussions with the owner of the concerned land, he proposed to the City an alternative portion of the lot, deemed less restrictive for the realization of his future development project, compared to the location initially envisaged by the City for the future school. This proposal was taken into consideration within the framework of this resolution, with the aim of reconciling the different interests present;

CONSIDERING THAT despite the steps and negotiations undertaken with the owner with a view to a mutual purchase agreement, no agreement could be reached to date;

CONSIDERING THAT being in the impossibility of arriving, to date, at a mutual agreement with the owner for the acquisition of the required rights and considering the schedule to be respected in the realization of the project, the Legal Affairs Service, the Asset Planning and Investment Service as well as the Real Estate Assets Service jointly recommend undertaking expropriation procedures on a part of the lots described in the preceding paragraphs:
