CONSIDERING THAT the building contains 345 housing units and a conditional use must be granted by the council for this purpose under the Règlement relatif aux usages conditionnels numéro 506-2005;
CONSIDERING THAT the request requires the granting of five minor variances to the provisions of Règlement de zonage numéro 532-2020, regarding exterior parking, increasing the width of the access to the land and the access aisle, and reducing the height of the building;
CONSIDERING THAT the layout of the exterior parking allows for accommodating three major tenants of the existing commercial building, who will be relocated to the Phase 1 building and who hold clauses in their leases that allow them to require parking spaces close to their respective premises and located on the same floor level;
CONSIDERING THAT the increase in the width of the access to the land allows for the development of a safe access of the "right turn only entry and exit" type with a central separator island, and the reduction of the minimum height of two stories of the proposed building is an adaptation of the height to the commercial use exercised only on the ground floor of the building;
CONSIDERING THAT, with the exception of the minor variances, this work complies with the provisions of Règlement de zonage numéro 532-2020, and that it respects the majority of the applicable objectives and evaluation criteria of Règlement relatif aux plans d’implantation et d’intégration architecturale numéro 505-2005;

IT IS PROPOSED BY COUNCILLOR MARC BUREAU, SECONDED BY COUNCILLOR MARIO AUBÉ, AND RESOLVED THAT this council grants minor variances to Règlement de zonage numéro 532-2020, for the project at 360, boulevard Saint-Joseph, aiming to:
• reduce the minimum height of the building from two to one story on a proportion of 32% of its footprint area; • increase the width of the access to the land and the access aisle from 10 m to 14.6 m; • authorize an exterior parking lot of 97 spaces; • reduce the distance between a parking space and a building wall from 6 m to 2.5 m; • reduce the width of the grassed or otherwise landscaped strip bordering the parking space from 1 m to 0 m.

CONSIDERING THAT a request aiming to demolish part of the existing commercial building and build its north side facade, and authorize a cadastral operation has been made for the property located at 320-350, boulevard Saint-Joseph;
CONSIDERING THAT the site at 320-350, boulevard Saint-Joseph (Galeries de Hull) is an integrated shopping center consisting of two buildings: a first building which is a large-scale shopping center, bearing the address 320, boulevard Saint-Joseph; and a second smaller building, occupied by a restaurant establishment having the address 350, boulevard Saint-Joseph;

CONSIDERING THAT the land is located in the downtown restructuring sector and in the landscape unit "6.3 shopping centers", and that the cadastral operation as well as the proposed work are subject to municipal council approval under the Règlement relatif aux plans d’implantation et d’intégration architecturale numéro 505-2005;
CONSIDERING THAT the developments of the residual lot which includes the shopping center (320, boulevard Saint-Joseph) must be carried out within the framework of the temporary redevelopment plan approved by the demolition authorization certificate of the structure parking, which was granted by the Urban Planning and Sustainable Development Department and which provides for redevelopments required to make this property compliant with the regulations in force, whether in terms of the maximum number of exterior spaces, surface landscaping, or plantations required on the land;
CONSIDERING THAT this same residual lot is subject to a global project which provides for several subsequent phases that fall within the framework of the redevelopment project of the entire site, but which require a modification to the downtown special urban planning program, because this project provides for building heights exceeding the limit set at 10 stories;
CONSIDERING THAT this project complies with Règlement de zonage numéro 532-2020, Règlement de lotissement numéro 503-2005 and satisfies the applicable criteria of Règlement relatif aux plans d’implantation et d’intégration architecturale numéro 505-2005;

CONSIDERING THAT a request to allow the expansion of a main building has been made for the property located at 111, rue Gérard-Gauthier;
CONSIDERING THAT the building currently houses the Centre d’hébergement et de soins de longue durée (CHSLD) de la Vallée-de-la-Lièvre, and that the proposed expansion is part of the seniors' home (maisons des aînés - MDA) model being implemented by the Ministry of Health and Social Services;
CONSIDERING THAT the project requires the council to grant two minor variances to Règlement de zonage numéro 532-2020 regarding the side margin on rue Bergeron and the rear margin;

CONSIDERING THAT the work carried out on the balcony and the eaves caused situations of regulatory non-compliance and new situations of encroachment outside the limits of the property covered by this request;
CONSIDERING THAT the regularization of the renovation work already carried out requires the approval of a specific project for the construction, modification, or occupation of a building (PPCMOI) under the Règlement relatif aux projets particuliers de construction, de modification ou d’occupation d’un immeuble numéro 507-2005 since this work was not subject to the issuance of a building permit;

CONSIDERING THAT the modular classrooms were installed before the issuance of a building permit with a rear margin of 3.25 m instead of 3.9 m as authorized by the PPCMOI;

Second resolution - PPCMOI - Expansion of a residential building at 771, boulevard Alexandre-Taché
CONSIDERING THAT a request to expand a single-family dwelling to allow for the addition of an eight-story building with 169 units was made for the property located at 771, boulevard Alexandre-Taché;
CONSIDERING THAT a first request was made in May 2023 for this property, aiming to expand a single-family dwelling to allow for the addition of a 5 to 10-story building with 159 units;
CONSIDERING THAT despite approval of the initial resolution projects by the municipal council for the heritage component (CM-2023-434), the specific project for construction, modification, or occupancy of an immovable (PPCMOI) (CM-2023-413), and the conditional use (CM-2023-402), the applicant decided to withdraw the request before the end of the approval process to rework the project to address concerns expressed by the public;
CONSIDERING THAT the project will be located on a transversal lot bordered to the north by boulevard Alexandre-Taché and to the south by boulevard de Lucerne, near boulevard Saint-Raymond, in zone Ha-12-006;
CONSIDERING THAT the land targeted by the request is occupied by the maison John-Hamilton, a cited heritage building governed by the Règlement citant en immeuble patrimonial la maison John-Hamilton numéro 513-6-2020, located at 771, boulevard Alexandre-Taché;
CONSIDERING THAT the maison John-Hamilton will be entirely restored according to its original appearance and that the proposed expansion respects the insertion criteria of the citation bylaw by maintaining the integrity, legibility, and predominance of the original building from boulevard Alexandre-Taché;
CONSIDERING THAT the project to build 169 units must also be approved by the council, under the Règlement relatif aux usages conditionnels numéro 506-2005;
CONSIDERING THAT the height of the building does not respect the maximum authorized by zoning, and a PPCMOI must be approved under the Règlement relatif aux projets particuliers de construction, de modification ou d’occupation d’un immeuble numéro 507-2005;
CONSIDERING THAT the urban plan limits the height of buildings in urban villages to six stories, but provides that any increase in the maximum height indicated may be authorized up to 10 stories in the form of a specific project satisfying the evaluation criteria of the Règlement relatif aux projets particuliers de construction, de modification ou d’occupation d’un immeuble numéro 507-2005;
CONSIDERING THAT the shading impact study of the projected building on neighboring properties and the public domain showed that a limited additional impact, over a period of the day, will be observed on the public domain and the property located to the east of the projected property due to the increase in height;
CONSIDERING THAT a study of the wind acceleration effect on pedestrians was filed, showing that the project respects the comfort criteria for pedestrians moving in the public domain and around the building, as well as in the relaxation spaces on the site;
CONSIDERING THAT the Urban Planning Advisory Committee, at its meeting of February 26, 2024, ratified the recommendation of the Urban Planning and Sustainable Development Department;
CONSIDERING THAT during the municipal council meeting of March 19, 2024, the first resolution number CM-2024-174 was adopted;
CONSIDERING THAT a public consultation assembly was held on April 9, 2024;
CONSIDERING THAT during the public consultation assembly, citizens raised concerns regarding the implementation of the project with a long lateral facade lined with several balconies on the west side directly opposite the apartments at 156, boulevard de Lucerne, while they preferred to face the interior courtyard planned on the east side of the project;
CONSIDERING THAT this council, during its meeting of April 16, 2024, adopted the second draft of the PPCMOI (CM-2024-266) with the same plans as the first project, given that the developer's representatives had not filed modified plans;
CONSIDERING THAT following the publication on April 24, 2024, of the public notice required by law, the Clerk's Office received two requests for the opening of registers compliant for zones Ha-12-006 (targeted zone) and Ha-12-004 (contiguous zone);
CONSIDERING THAT exchanges between neighboring citizens of the project and the developer's representatives resulted in the filing, on April 23, 2024, of a commitment letter from the developer's representatives to the neighboring citizens, in which they commit to filing modified plans aiming to invert the interior courtyard planned for the project, which necessitated the withdrawal of the file from the agenda of the May 14, 2024 council meeting which was to decide on the final adoption of the project in its initial version;
CONSIDERING THAT the developer's representatives filed, on June 4, 2024, with the Urban Planning and Sustainable Development Department (SUDD), modified plans (Campanella et associés – architecture et design, June 4, 2024) providing for the inversion of the project's implementation so that the interior courtyard is on the west side, which would satisfy the requests of neighboring citizens;
CONSIDERING THAT the revised plans must be submitted to the council in order to approve the PPCMOI again as a second resolution project, which requires the repeal of council resolution CM-2024-266 approved by the council on April 16, 2024;
CONSIDERING THAT despite the modified implementation of the project, it remains compliant with the evaluation criteria of the Règlement relatif aux projets particuliers de construction, de modification ou d’occupation d’un immeuble numéro 507-2005 regarding the minimization of shading effects on the neighborhood, the control of wind acceleration effects, and the maintenance of trees of interest on the site;
CONSIDERING THAT if the council adopts the second resolution project in its modified version with the new plans filed, the SUDD must organize an information evening to give interested citizens the opportunity to express their opinions on this new version and that an information point will be filed at the CCU of June 17, 2024, to notify this committee of the modifications to the project:
IT IS PROPOSED BY COUNCILLOR CAROLINE MURRAY, SECONDED BY COUNCILLOR MARIO AUBÉ, AND RESOLVED THAT this council approves, with change, under the Règlement relatif aux projets particuliers de construction, de modification ou d'occupation d'un immeuble numéro 507-2005, the second resolution of the specific construction project at 771, boulevard Alexandre-Taché aiming to allow an expansion to the existing building to make it a multi-family dwelling having the following characteristics:
- Its height will be eight stories;
- Its number of parking spaces will be 130 spaces, located entirely underground.
All as illustrated in the project analysis in the plans entitled:
- Implantation modifiée – Campanella et associés – architecture et design – Maison John-Hamilton projet de développement résidentiel – 2024-06-04;
- Vues en perspective du projet modifié – Campanella et associés – Architecture et design – Maison John-Hamilton projet de développement résidentiel – 2024-06-04,
and this, conditionally:
- To the cession of a strip of land 3 m wide along boulevard Alexandre-Taché for the development of a sidewalk;
- To the filing by the applicant, at the building permit stage, of engineer plans demonstrating all temporary and/or permanent protection measures for the maison John-Hamilton during the excavation and construction work of the expansion project at the rear.
Furthermore, it is understood that this resolution repeals the second project resolution CM-2024-266 adopted by the council on April 16, 2024. Furthermore, it is resolved that this resolution be without effect for elements not realized as of the date of final adoption of the project.

CONSIDERING THAT a request to authorize the installation of a third attached sign has been made for the property located at 415, boulevard La Vérendrye Est;
CONSIDERING THAT the property is located in commercial zone Co-04-110 subject to restrictive signage provisions limiting the maximum number of attached signs to one per establishment;
CONSIDERING THAT five existing commercial signs displaying the establishment were subject to the approval of a PIIA request by the municipal council, and that minor variances were granted for this purpose by the municipal council on August 23, 2012, by resolutions numbers CM-2012-751 and CM-2012-713;
CONSIDERING THAT the applicant wishes to remove three of the five existing signs in the form of decorative bands, keep the two main signs in the form of lettering, and install a third attached sign;

Private sale of lot 5 733 645 of the Quebec cadastre - Disused alley – 122, rue Wigwàs - Hull-Wright electoral district - Steve Moran
CONSIDERING THAT the City of Gatineau is the owner of parcels of land that constitute former alleys that have been unused and abandoned for many years;
CONSIDERING THAT in 2015, lot 5 733 645 (former alley) of the Quebec cadastre, Hull land registration division, was created to be transferred to the adjacent owner, but the transfer by the City in favor of the deceased or her legatee, owner of lot 1 084 247 and having the civic address 122, rue Wigwàs, has not been finalized to date;
CONSIDERING THAT this part of the former alley is occupied and maintained by the owner of the adjacent building and that she appears as the owner of the part of the alley on the City of Gatineau's assessment roll;
CONSIDERING THAT the owner of 122, rue Wigwàs has been paying taxes on this space for several years;
CONSIDERING THAT Ms. Ann Vallières, new owner of 122, rue Wigwàs since November 14, 2022, wishes to correct and confirm her property title on lot 5 733 645 of the Quebec cadastre, Hull land registration division;
CONSIDERING THAT following verification, it appears that there are no services (water or sewer) under this portion of the alley to be transferred. Thus, the transfer of the rights held by the City on this part of the alley in favor of the owner of 122, rue Wigwàs has no impact on the City;
CONSIDERING THAT all costs related to the transaction will be assumed by the applicant;
CONSIDERING THAT all concerned municipal departments have been consulted and are in favor of this transaction:
IT IS PROPOSED BY COUNCILLOR STEVE MORAN, SECONDED BY COUNCILLOR MARIO AUBÉ, AND RESOLVED THAT, following the recommendation of the executive committee number CE-2024-387 of June 11, 2024, this council:
- Transfers all rights, titles, and interests to Ms. Ann Vallières, owner of 122, rue Wigwàs, lot 5 733 645 of the Quebec cadastre, Hull land registration division, with an area of approximately 32.5 m², for $1 plus taxes if applicable, all in accordance with the promise to purchase signed by Ms. Vallières on March 28, 2024;

- Authorizes the Real Estate Department to extend any deadline for signing the deed of sale as provided for in the offer to purchase, if required;
- Removes the public character of lot 5 733 645 of the Quebec cadastre, Hull land registration division, covered by this transaction;
- Mandates the Real Estate Department to manage the sale in due form, ensuring compliance with the terms and conditions of the deed of sale to be executed;
- Authorizes the treasurer to perform the accounting entries required to give effect to this resolution.

Sale of part of lot 6 440 054 of the Quebec cadastre - 13, rue Laroche - Parc-de-la-Montagne‒Saint-Raymond electoral district - Marc Bureau
CONSIDERING THAT the City of Gatineau is the owner of lot 6 440 054 of the Quebec cadastre, Hull land registration division, which constitutes the right-of-way of a former alley on rue Laroche;
CONSIDERING THAT this right-of-way is surplus, encumbered by a real and perpetual public utility easement, and is not developable by itself;
CONSIDERING THAT despite section 28 of the Cities and Towns Act (chapter C-19) and the Act respecting the prohibition of municipal subsidies (chapter I-15), the Charter of the City of Gatineau allows the City to alienate, free of charge, in favor of the owner of a contiguous property, a parcel of land of low value;
CONSIDERING THAT with a view to rationalizing the real estate portfolio, the City of Gatineau can therefore alienate, free of charge, the right-of-way of its former alleys of low value, which are not developable by themselves and which can only benefit adjacent owners;
CONSIDERING THAT steps have been taken with adjacent owners to propose that they acquire the remaining parts of this alley;
CONSIDERING THAT following discussions with the surrounding owners, only Danièle Grenier, owner of 13, rue Laroche, has shown an interest in acquiring a part of lot 6 440 054 of the Quebec cadastre, with an area of 63.2 m²;
CONSIDERING THAT with this sale, the City of Gatineau will no longer have to assume maintenance and civil liability, in addition to benefiting from potential additional municipal tax revenue to be determined;
CONSIDERING THAT all departments have been consulted and are in favor of this transaction:
IT IS PROPOSED BY COUNCILLOR MARC BUREAU, SECONDED BY COUNCILLOR MARIO AUBÉ, AND RESOLVED THAT, following the recommendation of the executive committee number CE-2024-388 of June 11, 2024, this council:
- Sells, by private agreement, a part of lot 6 440 054 (future projected lot 6 630 348) of the Quebec cadastre, Hull land registration division, with an area of 63.2 m², for the symbolic sum of $1, under the conditions provided for in the City of Gatineau's standard contract and other conditions stipulated in the promise to purchase submitted and duly signed on April 19, 2024, by Ms. Danièle Grenier;
- Mandates the Clerk's Office to prepare the necessary documents related to the transaction and to coordinate all steps required to give effect to this resolution;
- Authorizes the Real Estate Department to extend any deadline for signing the deed of sale as provided for in the promise to purchase, if required;
- Removes the public character of this part of lot 6 440 054 (future projected lot 6 630 348) of the Quebec cadastre, Hull land registration division, if required;
- Authorizes the treasurer to perform the accounting entries required to give effect to this resolution.
The mayor or, in his absence, the acting mayor, and the clerk or, in her absence, the deputy clerk or assistant clerk are authorized to sign the documents for the purposes of this resolution.

Private sale of lot 6 493 261 of the Quebec cadastre and transfer of a parking easement on part of lot 6 493 262 of the Quebec cadastre - 2, rue Raoul-Roy - Aylmer electoral district - Steven Boivin
CONSIDERING THAT the City of Gatineau is the owner of lots 6 493 261 and 6 493 262, formerly known as lot 2 987 992 of the Quebec cadastre, Gatineau land registration division, which constitute part of the land occupied by Parc des Cèdres;
