CONSIDERING THAT the study submitted by the applicants, titled "Analyse de dessertes des services municipaux pour le développement urbain du projet Les Portes de l’Ouest", dated November 2, 2022, only considers the needs of the applicants' development project, without taking into account the needs for the potential development or redevelopment of other properties included in the urban expansion area, which does not allow for meeting condition no. 3 of section 88.1 of the Règlement d’administration numéro 501-2005;

CONSIDERING THAT conditions 2 and 4 are partially satisfied since the applicants' project is partly contiguous to municipal networks, but the letter of intent for an agreement regarding municipal works only concerns the applicants' properties without encompassing other potentially developable lands included in the Explorateurs urban expansion area;

CONSIDERING THAT an analysis is underway by the municipal administration to ensure that the residual capacities of the drinking water and wastewater treatment plants first meet the needs of priority 1 and 2 sectors in accordance with the vision of the Schéma d’aménagement et de développement, before proceeding with the evaluation of the service needs of the Explorateurs urban expansion area;

CONSIDERING THAT it is the result of this analysis that will allow for evaluating the necessity or not of increasing the capacities of the drinking water supply and wastewater treatment plants to ensure the current and future needs of the territory and thus meet condition 3;

CONSIDERING THAT the Urban Planning Advisory Committee, at its meeting of August 19, 2024, ratified the unfavorable recommendation of the Service de l’urbanisme et du développement durable and recommends to the council not to open the Explorateurs urban expansion area:

IT IS PROPOSED BY COUNCILLOR GILLES CHAGNON, SECONDED BY COUNCILLOR MIKE DUGGAN, AND RESOLVED THAT this council approves the opening of the Explorateurs urban expansion area despite the fact that the conditions enacted in section 88.1 of the Règlement d’administration numéro 501-2005 are not entirely satisfied. CONSIDERING THAT an initial request was made in May 2023 for this property, aiming to expand a single-family dwelling to allow for the addition of a 5 to 10-storey building containing 159 units;

CONSIDERING THAT despite approval of the initial draft resolutions by the municipal council for the heritage component (CM-2023-434), the specific construction, modification, or occupancy project (PPCMOI) (CM-2023-413), and the conditional use (CM-2023-402), the applicant decided to withdraw their request before the end of the approval process in order to rework their project to address concerns expressed by the public;

CONSIDERING THAT a second request aiming to expand a single-family dwelling to allow for the addition of an eight-storey building containing 169 units was made in December 2023 for the property located at 771, boulevard Alexandre-Taché;

CONSIDERING THAT the Urban Planning Advisory Committee, during its meeting on February 26, 2024, ratified the recommendation of the Urban Planning and Sustainable Development Service and favorably recommended the approval of the project. During the municipal council meeting of March 19, 2024, the first resolution number CM-2024-174 was adopted;

CONSIDERING THAT during the public consultation assembly held on April 9, 2024, citizens expressed their concerns regarding the implementation of the project with a long lateral facade adorned with several balconies on the west side;

CONSIDERING THAT this council adopted, during its meeting on April 16, 2024, without modification, the second draft resolution aiming to authorize a specific construction project. Following the adoption of this second draft resolution, a notice was published, as this latter resolution contained provisions subject to referendum approval and valid requests were received for zones Ha-12-006 (affected zone) and Ha-12-004 (contiguous zone);

CONSIDERING THAT the developer's representatives submitted, on June 4, 2024, modified plans (Campanella et associés – architecture et design, June 4, 2024). These plans essentially provide for the same project in terms of size, height, and number of units, but with an inverted layout ensuring that the interior courtyard is located on the west side, in order to take into account the comments made during the public consultation;

CONSIDERING THAT these modifications were the subject of a council resolution as a second draft during the municipal council meeting of June 11, 2024 (CM-2024-478).
