WHEREAS a financial participation from the federal government of $2.2 billion under the Programme de transfert pour les infrastructures d’eau et collectives du Québec (TECQ) for the years 2024-2028 resulting from the administrative agreement regarding the Fonds pour le développement des collectivités du Canada (FDCC) came into effect on June 21, 2024;

WHEREAS the government of Quebec is providing a financial participation of $1.1 billion to the Programme de transfert pour les infrastructures d’eau et collectives du Québec (TECQ) for the period 2024-2028, allowing for a total aid of $3.3 billion for the period 2024-2028;

WHEREAS the basic financial aid for the City of Gatineau amounts to $86.853 million, established according to the population decree for the year 2024;

WHEREAS a first grant bonus of $4.342 million is granted by the ministère des Affaires municipales et de l’Habitation (MAMH) to the City of Gatineau following its commitment to the water asset management plan (PGA-Eau) process;

WHEREAS a second grant bonus of $4.342 million will be granted by the MAMH to the City conditionally upon the submission by the latter of its PGA-Eau before the end of the year 2026;

WHEREAS the City of Gatineau has reviewed the Guide regarding the terms of government contribution under the Programme de transfert pour les infrastructures d’eau et collectives du Québec (TECQ) for the years 2024-2028 for drinking water and sanitation infrastructure as well as local roads;

WHEREAS the City of Gatineau must comply with the terms of this guide that apply to it to receive the government contribution that has been confirmed to it in a letter from the Minister of Municipal Affairs and Housing;

WHEREAS to obtain the financial aid, the City of Gatineau must also submit to the MAMH a work program that complies with the eligible work categories:

IT IS PROPOSED BY COUNCILLOR STEVE MORAN, SECONDED BY MAYOR MAUDE MARQUIS-BISSONNETTE, AND RESOLVED THAT this council:

WHEREAS the New Horizons for Seniors Program supports the implementation of concerted actions aimed at social inclusion, citizen participation, and improving the quality of life of vulnerable and at-risk seniors;

WHEREAS the City has submitted a Collective Impact Plan and a work plan aimed at significantly increasing the social inclusion of vulnerable seniors in Gatineau, and sub-projects have been identified and validated by local partners during consultations and thematic meetings held over the past few months;

WHEREAS the collaborating organizations (Table des aînés de Gatineau, Solidarité Gatineau Ouest, Table de concertation des aînés et des retraités de l’Outaouais, Centre d’Animation Familiale de l’Outaouais and Loisir sport Outaouais) are non-profit organizations, recognized in the territory, and they have expertise as well as a network of partners allowing them to support the sub-projects of the Collective Impact Plan;

WHEREAS the City of Gatineau has been actively intervening for several years to support the realization of social and affordable housing projects on its territory;

WHEREAS the Politique d’acquisition et de disposition des biens immobiliers PO-029 (hereinafter referred to as "the Policy") provides, in section 12, that the sale of municipal land to a non-profit organization (NPO), a housing cooperative, or the Office d’habitation de l’Outaouais (OHO), when carried out in the context of the realization of an affordable and/or social housing project in connection with municipal or governmental programs, is done free of charge. The market value of the land is considered in the financial structure as a subsidy and as a contribution from the City;

WHEREAS in certain recent files, the realization of these projects required the temporary occupation of additional municipal land to allow for the storage of construction materials, the installation of construction trailers, or the development of temporary spaces required for the execution of the work. This occupation was not, however, exercised by the eligible organization, but by the construction contractor in charge of the project;

WHEREAS, in accordance with the Loi sur l’interdiction de subventions municipales, the City had to conclude a separate agreement with the contractor at fair market value. This situation led to an adjustment of the financial structure of the project carried by the eligible organization. This requirement had the effect of increasing the costs of the project carried by this organization and, in some cases, compromising its financial viability;

WHEREAS it is therefore important to clearly distinguish the aid granted to the eligible housing project from any use of municipal domain by a general contractor or subcontractor;

WHEREAS, moreover, the recent adoption of section 84.2 of the Loi sur les compétences municipales expressly confirms the power of municipalities to grant aid aimed at increasing or maintaining the supply of social, affordable, or student housing;

WHEREAS the proposed modification of the Policy to frame this provision of additional municipal land is mainly translated by the addition of section 12.2.1 providing that the City may make available, free of charge and on a temporary basis, additional municipal land for the exclusive purposes of the construction of a project covered by section 12.2 of the Policy. This temporary loan of additional municipal land must:

• be directly linked to the construction of the housing project; • benefit exclusively the eligible organization; • be strictly limited to the duration required for the realization of the construction work and end at the latest upon the completion thereof; • be the subject of a separate written agreement between the eligible organization and the City, specifying in particular the duration, the conditions of occupation, the rights and obligations of the parties, as well as any other applicable terms; • be approved by the competent municipal authority:
