Minor variances - Expand a two-family dwelling and transform it into a three-family dwelling - 21, rue Duquesne - Manoir-des-Trembles–Val-Tétreau electoral district - Jocelyn Blondin
The Council approved minor variances for 21, rue Duquesne to allow the expansion of a two-family home into a three-family home. The variances address the building-to-land ratio and the distance between an outdoor driveway and the building wall, as the existing building's previous non-conforming status would be lost upon expansion.
Read full translation

CONSIDERING THAT a request to expand a detached three-family dwelling has been made for the property located at 21, rue Duquesne; CONSIDERING THAT the expansion project aims to add a third dwelling over two floors at the rear of the existing building; CONSIDERING THAT the project requires the granting, by the municipal council, of two minor variances to Zoning Bylaw number 532-2020 in order to reduce the minimum building-to-land ratio and the minimum distance required between an outdoor access driveway and the building wall; CONSIDERING THAT the existing two-family dwelling is a non-conforming construction protected by acquired rights, because at the time of its construction in 1959, it complied with the provisions of the former Zoning Bylaw number 578 of the former city of Hull, since no minimum was prescribed for the building-to-land ratio; CONSIDERING THAT the expansion of the main building by adding a third dwelling, as proposed in the project, implies the extinction of acquired rights, and makes the building-to-land ratio non-compliant with the provisions of the current Zoning Bylaw number 532-2020; CONSIDERING THAT the realization of an expansion greater than that proposed, in order to increase the building-to-land ratio to the minimum required ratio of 0.35, would imply the reduction of the area of amenity spaces, as well as its non-compliance with the provisions of Zoning Bylaw number 532-2020; CONSIDERING THAT the narrow shape of the land and the presence of the already constructed building do not allow the access driveway to be placed at a distance of 1.5 m from the building wall without implying other non-compliances with Zoning Bylaw number 532-2020; CONSIDERING THAT the majority of neighboring buildings have a similar building-to-land ratio, that the minor variances do not aim to bring the building closer to neighboring properties, and that the minimum setback margins of the expansion are respected in the proposed project; CONSIDERING THAT with the exception of the requested minor variances, the project complies with all other provisions of the zoning and subdivision bylaws in force; CONSIDERING THAT in accordance with the provisions of Bylaw number 851-2023 on the methods of publication of public notices, a public notice was published on October 30, 2024, on the City of Gatineau website and that it was published at least 15 days before the meeting where the council must rule on the minor variance request, as indicated in section 145.6 of the Loi sur l’aménagement et l’urbanisme; CONSIDERING THAT the Urban Planning Advisory Committee, at its meeting of October 28, 2024, ratified the recommendation of the Urban Planning and Sustainable Development Department: IT IS PROPOSED BY COUNCILLOR JOCELYN BLONDIN, SECONDED BY COUNCILLOR CAROLINE MURRAY, AND RESOLVED THAT this council approves minor variances to Zoning Bylaw number 532-2020, at 21, rue Duquesne, in order to expand a two-family dwelling to transform it into a three-family dwelling, aiming to reduce: • the minimum building-to-land ratio from 0.35 to 0.30; • the minimum distance between an outdoor access driveway and the wall of a building housing a three-family dwelling from 1.5 m to 0 m. As illustrated in the project analysis in the documents entitled: • Site plan identifying the requested minor variances – Michel Fortin, land surveyor – September 17, 2024 – 21, rue Duquesne – Annotated by the (SUDD); • Building site plan with the projected expansion – Beaulieu Construction – August 28, 2024 – 21, rue Duquesne. Furthermore, it is resolved that this resolution shall be without effect for elements not completed as of November 19, 2029. Adopted
